Expungement
What is an expungement? An expungement is requesting that the Court clears a criminal record or criminal conviction or criminal charge from a background check. Depending on each state, a person can get rid of a criminal record that is a felony or a misdemeanor or both. For example, in the State of Michigan, individuals can expunge or erase a criminal record that is a felony or a misdemeanor.
Prior to 2021, the State of Michigan only allowed expungements to individuals that had 1 felony and up to 2 misdemeanors. However, as of April 2021, that law has changed. Today, an individual is allowed an expungement if the individual has up to 3 felonies and an unlimited number of misdemeanors. The new “Clean Slate” Law will help hundreds of thousands of Michiganders, and we are in the business of helping individuals that have any questions on your eligibility.
Some of the most common criminal records that can be expunged:
(1) CCW (Weapons charge or weapons convictions)
(2) Robbery
(3) Retail Fraud
(4) Traffic violations

When can I start my expungement process for a felony?
If you have a felony, you must wait at least 5 years from the date of the last thing that took place in your case. In other words, the clock starts after prison time, or after probation or after parole. For example, John was charged with a felony CCW on June 1, 2000. John was placed on parole or probation for 5 years. John will complete with his parole or probation on June 1, of 2005. John must wait until June 2, 2005, to start his expungement process.
When can I start my expungement process for a misdemeanor?
If you have a misdemeanor, you must wait at least 3 years from the date of the last thing that took place in your case. In other words, the clock starts after probation or after parole. For example, John was charged with a felony CCW on June 1, 2000. John was placed on parole or probation for 5 years. John will complete with his parole or probation on June 1, of 2003. John must wait until June 2, 2003, to start his expungement process.
After getting a criminal record expunged on your next job questionnaire that says “Have you had a felony? Select yes or no.” You can select the “no” box because the record will not show up on a background check. You will be able to apply for that job promotion without wondering the employer will find out about your past criminal record. When applying for a new apartment you do not have disclose the previous criminal records that was expunged.
